1. Terms and Conditions
By accessing the Aflo Clients LLC web site (“ACWS”), you are agreeing to be bound by these ACWS Terms and
Conditions of Use, all applicable laws, and regulations, and agree that you are responsible for compliance with any
applicable laws. If you do not agree with any of these terms, you are prohibited from using or accessing the ACWS,
entering into an agreement with, buying services from or otherwise engaging in any business with Aflo Clients LLC
(“AC”). The materials contained in the ACWS are protected by applicable copyright and trademark law.
2. Use License
a. Permission is granted to temporarily download one copy of the materials (information or software)
on the ACWS site for personal, non-commercial transitory viewing only. This is the grant of a license,
not a transfer of title, and under this license you may not:
i. modify or copy the materials;
ii. use the materials for any commercial purpose, or for any public display (commercial or
non-commercial);
iii. attempt to decompile or reverse engineer any software contained on ACWS;
iv. remove any copyright or other proprietary notations from the materials; or
v. transfer the materials to another person or “mirror” the materials on any other server.
b. This license shall automatically terminate if you violate any of these restrictions and may be
terminated by at any time by AC. Upon terminating your viewing of these materials or upon the
termination of this license, you must destroy any downloaded materials in your possession whether in
electronic or printed format.
3. Disclaimer
a. The materials on ACWS are provided “as is.” AC makes no warranties, expressed or implied, and
hereby disclaims and negates all other warranties, including without limitation, implied warranties or
conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property
or other violation of rights. Further, AC does not warrant or make any representations concerning the
accuracy, likely results, or reliability of the use of the materials on ACWS or otherwise relating to such
materials or on any sites linked to ACWS.
4. Limitations, Legal, Termination and Refund
In no event shall AC be liable for any damages (including, without limitation, damages for loss of data or profit, or
due to business interruption,) arising out of the use or inability to use the materials on ACWS, even if AC or an AC
authorized representative has been notified orally or in writing of the possibility of such damage. Because some
jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental
damages, these limitations may not apply to you.
By sending written notice to AC, you can terminate your AC service and AC subscription at any time, but you agree
that you will not be eligible for nor will AC be required to refund any amounts that you have paid to AC for services
prior to the date of such termination. In the event you are (i) not receiving AC services that you paid for or
subscribed to or (ii) having any technical or connectivity issues with your AC services or your AC subscription, you
agree that it is your duty and responsibility to immediately contact AC’s customer support department (“Customer
Support”) when such problems occur (and not to delay contacting Customer Service for any reason). Customer
Support will collaborate with you to correct any such problem that you may be having and will work diligently to
get your AC service and subscription working properly. You agree that you will not be eligible for any refunds for
the period of time that your AC service or AC subscription is not working properly as it is your duty to contact
Customer Service immediately when such problems occur so that it can be remedied. Again, you may terminate
your AC service and AC subscription at any time subject to the provisions of this paragraph.
5. Revisions and Errata
The materials appearing on ACWS could include technical, typographical, or photographic errors. AC does not
warrant that any of the materials on ACWS are accurate, complete, or current. AC may make changes to the
materials contained on ACWS at any time without notice. AC does not, however, make any commitment to update
the materials.
6. Links
AC has not reviewed all of the sites linked to ACWS and is not responsible for the contents of any such linked site.
The inclusion of any link does not imply endorsement by AC of the site. Use of any such linked web site is at the
user’s own risk.
7. Site Terms of Use Modifications
AC may revise these terms of use for its web site at any time without notice. By using the ACWS you are agreeing
to be bound by the then current version of these Terms and Conditions of Use.
8. Governing Law
Any claim relating to ACWS shall be governed by the laws of the State of Delaware without regard to its conflict of
law provisions.
The servers and other administrative elements of AC are located outside the U.S. area. By using AC, you agree to
bear full responsibility for observance and compliance of and with any laws (including but not limited to copyright)
in respect to the networks and services that you are accessing through AC in accordance with the legislation of the
country in which you reside. You agree to indemnify and hold AC harmless in the event you are using AC in any
manner that conflicts with or violates the laws of the country in which you reside as well as any claims made against
AC in connection with your use of the networks and services that you are accessing through AC.
